This constitutes the “agreement” between users of the site (“You” or “Users” or “Writers”) and ireadiwrite Publishing (“ireadiwrite” or “Site” or “us” or “we”) stating the terms that govern your use of the ireadiwrite store. By using this site you agree to these terms, if you do not agree to these terms, then do not use the site. If you have any questions, please don’t hesitate to contact us.

1. Definitions

ireadiwrite refers to this online store that sells the works of authors in a downloadable electronic format. Authors who publish with ireadiwrite Publishing are referred to as “Writers” and anyone may purchase the content that is published on the site. All published original content is referred to as “Work”. Customers of the store are referred to as “Readers”.


2. Submission of Work

Writers may submit their work for publishing. For details on requirements, please visit the 'for Writers' page on the Site. By submitting Work to the Site, the Writer represents and warrants at all times of this Agreement, that the Work:

• Is owned by you or, if owned by someone else, that you have appropriate permission to reproduce the Work.
• Does not violate any copyright, or other intellectual property right of any third party;
• Does not invade any individual's privacy rights;
• Does not contain material that is unlawful, obscene, defamatory, pornographic, harassing, hateful, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory, or otherwise objectionable;
• Does not break the law, or encourage or facilitate the breaking of the law;
• Does not offer or disseminate fraudulent goods, services, schemes, or promotions, or promote domain names, URLs, or hyperlinks that constitute commercial content such as that found in advertising, promotions, or solicitations;

3. Published Writers

All Writers published by ireadiwrite Publishing sign a separate individual contract, stipulating the terms of their publishing agreement.


4. Site Use

The Site is not responsible for any inadvertent damage to, corruption or destruction of the Work either in the transmission, storing, posting or sale of the Work. Given this, it is the responsibility of the Writer to back up all Work. In addition to complying with all restrictions listed in these Terms, you are responsible for adhering to all local and national laws that pertain to your location, wherever you are.

ireadiwrite Publishing reserves the right to place advertisements on the Site. While we encourage the use of various electronic reading devices, and post general instructions on usage, we are not able and do not support the technical aspects of transferring Works to these devices. For more detailed technical advice, contact the manufacturer of your device.

6. Payment Terms

All Work purchased from the site is not available until after a successful PayPal transaction. A download code will become available after this and will also be sent by email to you which will make the work available for download for 12 hours after the transaction. Any technical issues with the download should be communicated immediately to orders@ireadiwrite.com


7. Returns

ireadiwrite Publishing does not provide refunds on Works. If you have technical issues with a download, please advise us immediately and it will be rectified.


8. User Registration and Information

In order to use the site, you must register with ireadiwrite. During this process, you will have the opportunity to select a username and password during the User registration process. You are solely responsible in all respects for: (a) all use of the Site made using your username and password, and (b) maintaining the confidentiality of your username and password. Only one individual may access the Site at the same time using the same username and password. You agree to notify us immediately of any unauthorized use of your e-mail address, username or password or any other breach of security regarding the Site of which you are aware. ireadiwrite may refuse a username or password that impersonates someone else, is protected by trademark or other proprietary right law, is vulgar or otherwise offensive, or for any other reason. It is your responsibility to keep current all of your User Information on the Site.


9. Terminating Account

If you wish to terminate your registration, please email info@ireadiwrite.com


10. Restrictions on Use of Works

If you purchase Work from the Site you or any other party may not resell, redistribute, sublicense, assign, delegate, share, copy, adapt, redistribute, reconfigure, modify or create derivatives from Work unless you obtain explicit consent from the Writer who owns the Work. Doing so contravenes copyright laws.


11. International Users

If you access this Site from a location outside of Canada, you are responsible for compliance with all applicable local laws and any local taxes that may be payable. If you live outside of Canada, you agree not to bring, send or otherwise distribute purchased Works to Canada. Doing so is in violation of Canadian tax laws and will be subject to duties, taxes and/or fines and is the sole responsibility of the User.


12. Operation of Site

Technical, maintenance and other issues may make the Site unavailable from time to time. ireadiwrite Publishing makes no commitment, warranty or guarantee that the Site will operate in a timely, uninterrupted or error-free manner, or that the Site will meet User's purposes. ireadiwrite may also in its discretion modify the features, availability, operation and/or look and feel of the Site from time to time without notice to our users.


13. Disclaimers

ireadiwrite provides clean file formats for download. While we test all files for viruses and malicious content, we are not liable for any damage to your computer, data, software, files, or peripherals that may be caused by your use of the site and downloading Work. The information on this web site is provided on an "as is" basis.

To the fullest extent permitted by law, ireadiwrite:

• excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website; and
• excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised ireadiwrite of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages. ireadiwrite does not however exclude liability for death or personal injury caused by its negligence.
  

The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.


14. Indemnification

You shall indemnify and hold ireadiwrite Publishing harmless against all third party claims, demands, suits, actions, judgments, losses, costs, damages (direct, indirect and consequential), attorney's fees and expenses that ireadiwrite may sustain or incur by reason of any breach or alleged breach of any representation, warranty, term or condition of this Agreement, and for any act or omission by you which is in any way related thereto.


15. Term

This Agreement is effective until terminated. ireadiwrite may terminate or suspend this Agreement immediately for any reason and without prior notice to you. You may terminate your Account by contacting us by email. Your request to terminate will become effective within 30 days your specific request has been acknowledged by ireadiwrite. If you choose to terminate your Account, the terms of this Agreement regarding any Work you have submitted remain applicable. All provisions of this Agreement relating to payment, commissions, service fees, disclaimers, limitations of liability, indemnification, confidentiality, and proprietary rights shall survive termination.
